4. TERMS OF USE

These Terms of Use (“Terms”) apply to all individuals who access or use the Platform on the following website: https://careers.werecruit.io/fr/alcatel-submarine-networks (“Platform”).
The following Terms constitute a binding agreement between the User and ASN, and are deemed accepted in their integrity without any reservations, each time the User accesses or uses the Platform.
If the User does not accept these Terms, then he won’t be granted access or be allowed to use the Platform.

5. DEFINITIONS

“Candidate”: means a User who has applied to a Job Offer via the Platform;
“Account”: means a personal secure account which allows a User to apply to a Job Offer. The account can be accessed with an email address and a password, which can be changed by the User at any time on the Platform;
“Host”: means the company that provides the technical means to operate the Platform;
“Job Offer” or “Offer”: means a job offer detailing the profile needed for the job, which has been posted by ASN on the Platform to recruit a Candidate;
“Platform”: means the website implemented by the Host, which can be accessed at https://careers.werecruit.io/fr/alcatel-submarine-networks linking Users and the Recruiter;
“Profile”: means a set of data relating to a User, allowing for the creation of an Account;
“Recruiter” or “ASN”: means the company submitting the Job Offer on the Platform, Alcatel Submarine Networks;
“User”: means an individual who has created a Profile on the Platform.

6. SCOPE

These Terms apply to all the Offers, activities and services on the Platform.
If any provision of the Terms is held invalid or unenforceable by any court of competent jurisdiction, the other provisions of the Terms of Use will remain in force.
7. TERM

These Terms have been published on the 17th of December 2017 and will remain in full force and effect, unless it has been determined otherwise by law. The User may stop using the Platform at any time.
Notwithstanding, ASN reserves the right, at its sole discretion, to implement new elements as parts or additions to the Platform, as well as software, applications or new features, including changes that may affect the previous operation of the Platform. Any implementation of changes or new functionalities will correspond with ASN’s desire to improve the Platform, regardless of the consideration of the Users.
8. DESCRIPTION OF THE PLATFORM

The Platform allows for Users to view Offers published by ASN, and to apply as a Candidate after creating an Account.

9. ACCESS AND USE OF THE PLATFORM

The Platform is accessible on the Internet, free of charge, 24 hours a day, 7 days a week, all year long, to any User with access to the Internet. All costs relating to accessing the Platform, whatever they may be (including material costs or access to the Internet) are exclusively at the expense of the User who is solely responsible for the use of his computer equipment and Internet access.
To view the Job Offers, a User needs to create an Account.
The use of the Platform implies the acceptance, without reservations, of the Terms.
The User may not use the Platform for purposes other than those specified in the Terms.
Access to the Platform is limited to manual use only, any use of a robot is forbidden.

10. THE ACCOUNT

The creation of an Account is necessary so that a Candidate may apply to a Job Offer posted by ASN.
To create an Account, the User needs to click on the button “New User Registration” which can be found on the home page of the Platform. The User will need to fill out the form with the following information:

- Full name
- Email address
- Birth date
- Contact phone number
- Request source
- Password
- Confirmation of the password
- Acceptance of the Terms of Use

The Account can be deleted at any time by the User via his Profile.

11. THE PROFILE

The Profile contains the User’s personal information. The creation of a Profile is necessary if a User wishes to apply to a Job Offer. The Candidate’s Profile can be accessed via the button “Your CV”. The Candidate will need to fill out the form with the following information:

- Full name
- Languages
- Email address
- CV (mandatory to apply to an Offer)

Further optional information may be provided by the Candidate in his Profile. The optional information does not constitute a criterion for the selection of applications. Certain information provided by the Candidate when creating his Profile will only be visible by himself and ASN. ASN may only access the information provided by the Candidate when the Candidate applies to a Job Offer published by ASN.
The Candidate’s Profile may be changed or deleted at any moment by accessing the page via the button “Your CV”.
Users who violate these Terms may have their Profile terminated, at ASN’s discretion.

12. MODIFICATIONS OF THE TERMS OF USE AND OF THE PLATEFORM

ASN reserves the right, without notice, to permanently or temporarily suspend the use of all or part of the Platform, in particular to update, modify and maintain it, and in general, for any other technical or organizational reason. ASN also reserves the right, without notice, to modify or to update the Terms.
Changes to the Terms and the Platform will come into effect when they are published online, and shall be binding once the User accesses the Platform.
The use of the Platform implies the acceptance of any revision or modification of the Platform and its Terms.

13. ASN’S OBLIGATIONS

ASN undertakes to comply with all the regulations in force, in particular with the Regulation (EU) 2016/679 of the 27th of April 2016 on the protection of personal data (“RGPD”), and with the “Loi Informatique et Liberté modifiée n°78-17 du 6 janvier 1978” on the processing of personal data. Further information concerning the collection and processing of personal data is available on the Privacy Policy.

14. USERS’S OBLIGATIONS

ASN is not responsible in the case of identity theft of a User, in particular when a User communicates false information on the Platform. Identity theft is an offence punishable by article L.226-4 of the French Penal Code. Users are invited to inform ASN without delay, by email, if they suspect an individual is using their Account or their identity. The User shall hold ASN harmless against any third-party recourse in this regard.
The User undertakes to ensure that the information and/or data he communicates during his registration does not infringe the rights of third-parties nor violate any applicable laws. In addition, User warrants that the Personal Data (as defined in the RGPD) he communicates to ASN during his registration is accurate, complete and up to date. The User undertakes in particular to provide a valid email address.
The User is solely responsible for maintaining the confidentiality of his Account, Profile and passwords, and for all actions performed under his login details.
All content uploaded by the User that damages, deteriorates, renders unusable, overloads or interferes with the services of the Platform is prohibited. Furthermore, it is strictly forbidden for a User to attempt to access the Platform by means of hacking or any other unauthorized process. The User is responsible for the use that he makes of the information made available to him by ASN on the Platform, and must therefore ensure that he is in possession of all the necessary elements needed to make a decision that respects his interest.
ASN reserves the right to take any action necessary to ensure the compliance by the User with these Terms.

15. DISCLAIMER OF WARRANTY

ASN disclaims all liability for any technical malfunction of the Platform, including but not limited to failure of any telephone network or service, computer systems, servers, computer or mobile phone equipment, software, failure of email delivery, account login, traffic congestion on the Internet. Under no circumstances will ASN be responsible for any loss or damage to the User’s or any third-party’s computer, mobile phone or any other equipment or software, incurred in connection with the use of the Platform.

16. LIMITATION OF LIABILITY

ASN disclaims all liability, including: - Any direct damages (particularly immaterial) relating to the use of the Platform (including content and access) by the User or any third-party via his Account, as the User remains solely responsible for the security of his Account;
- Any decisions that could be taken by the User on the basis of information available on the Platform;
- In the event of temporary or total unavailability of all or part of the Platform, a problem caused by delays in the response time, and in general, any performance defect of all or part of the Platform.

17. CONFIDENTIALITY

ASN and the User (the “Parties”) shall refrain from disclosing any confidential information obtained in connection with the Job Offer to third-party. Information is considered confidential when a Party indicates it to be, or when the information is confidential by nature, or when the Parties know or are expected to know that the information is confidential, provided that the information is not already publicly known.
If as a result of a legal provision or court decision, ASN is required to disclose confidential information to third-parties designated by the law or a competent judge, and cannot invoke a right of exception, then ASN is not liable for damages or compensation.

18. GOVERNING LAW, DISPUTE RESOLUTION

This Platform and its Terms are governed by French law.
In the any disputes, and following the failure to find an amicable solution, the Parties shall submit to the exclusive jurisdiction of the French Courts. Please address any questions relating to these Terms to the following email: HR@asn.com
